Gemoedsbezwaren: NO insurance, drive!

Gemoedsbezwaarden leggen hun en uw lot in handen van God
In the Netherlands drive more than 5,000 vehicles around without insurance(!) because the owner of the car faith no premium to pay. And by vehicles, we mean everything from mopeds to trucks. We dived even deeper into this matter to find out how easy you are actually under an insurance policy can come out.

A gemoedsbezwaarde is someone who has faith refuses insurance to pay, because he or she lives according to the belief that the life is in the hands of God. God gives and takes when he wants, and so is an insurance is not necessary. That a gemoedsbezwaarde for example, his health insurance refuses to pay interests me not so: if that person gets sick, then he has within himself. Of course, you can have an opinion about it not to vaccinate small children against deadly diseases, but that discussion we cannot enter, it goes on this site about cars. And where for me the shoe is a little bit starts to twist, that is, a traffic accident often two parties are involved. In the case that a gemoedsbezwaarde the culprit, then the victim with the baked pears sit if there is no insurance on the vehicle of the gemoedsbezwaarde rest.

Inquiring at the Social Insurance Bank (SVB) has shown that this type of claims handled by the guarantee Fund. Because they themselves are best able to describe what they do, I have this text as borrowed from their website:

“The guarantee Fund motor Traffic is there for people who by an accident with a motor vehicle have suffered damage and that damage cannot go to an insurer because the vehicle is unknown or uninsured.”

Now, in case of an accident with a gemoedsbezwaarde of course, just to know who the culprit is. The guarantee Fund therefore takes after an accident, always contact the gemoedsbezwaarde to check whether this damage is going to pay for it. Turns out this is not the case (or not possible) then takes the guarantee Fund the payment for her account. But as an employee of the guarantee Fund notice on the phone: “There is not time for Christmas played!” There is paid so that the victim does not have to wait for reimbursement, but the damage is subsequently recovered from the person who caused the accident.

RDW: 5.000 vehicles are not insured
Discussion with the RDW teaches us that there are currently around 5,000 vehicles with REGISTER code 999 registered. This means that these vehicles driving around while they are not insured, they have a waiver for the obligation to take out insurance. However, it is not so that there are also 5,000 people who will, because of gemoedsbezwaren no insurance for their auto pay, because there are people who have multiple cars in their name. For example, there are also companies with several trucks, a waiver, and, therefore, uninsured trucks on the road. The driver of an uninsured vehicle is also not per definition a gemoedsbezwaarde.

Unlike health insurance, there is no compensation in the Tax asked for these people and so pay these people simply do not have insurance for their car. However, they have an annual fee of about 100 euros to pay for the exemption. This amount is in the cash of the guarantee Fund deposited to damages to compensate, but this is absolutely not a insurance premium.

Number of these people increases
The number of vehicles for which an exemption gemoedsbezwaren is issued is growing steadily. Since 2008 this has grown from 4001 to 4437 gekentekende-, and from 703 to 867 not gekentekende motor vehicles and mopeds. Per year, there are a few dozens of cases dealt with by the compensation Fund, says director Jelle Smits. In 2012, there were 22 harm caused by motor vehicles with an exemption gemoedsbezwaren. The total damage amounted to then € 194.000 euro. In 2011, the amount is much higher, namely € 708.000 euros and that while the number of claims was slightly lower with 20 pieces.

The State of the Netherlands is of course not a guarantee for the liability due to gemoedsbezwaren uninsured vehicles but eventually, the costs are (at least partly) recovered from the these people by means of the previously mentioned annual contribution. That varies so per year, and that you encounter sometimes in protest at the these people. And that while they have little reason to complain because “approximately 100 euros per year” is still much less than the rest of us have to pay for our car insurance. In fact: the penalty for not on time payment of your car insurance policy will cost you €380 euro to the RDW.

That leads directly to a number of questions. First of all, driving these people as much as prudent, or are we being scammed by our insurers? The answer to that question, you’re probably familiar with. Second: how easy is it to as gemoedsbezwaarde considered to be, because who would not want to hundred euros per year for his car insurance?

Exemption from the obligation to take out insurance
According to the guarantee Fund, the RDW and the Social Insurance bank teaches us that to request an exemption from the obligation to take out insurance for a motor vehicle a form requested must be at SVB. It must be shown that the owner of the car, no insurance wish to make a claim. So not on a health insurance, not car insurance but also, for example, not on an insurance company or something like that. Additionally, the same should apply for any people that lived together. If the gemoedsbezwaarde this statement sign is checked whether he or she is really no insurance has run and if that is the case the exemption is granted.

Thus, it is not easy to for an exemption in order to qualify, and it brings a number of risks with it, but it is strange that you as a citizen are required of your car insurance while there are people who are there to ruin. Because of a certain belief. That The State (and indirectly the tax paying Dutch citizen) have to ensure this kind of cases, it doesn’t feel good.
